Существо оферты в одном абзаце. Настоящий документ является публичной офертой (смешанным договором): он объединяет лицензионный договор (Вариант А — доступ к расширенным функциям Приложения, в том числе отключение рекламы) и договор отчуждения/передачи прав на исходный код (Вариант Б — продажа кода). Акцептом является оплата выбранного продукта через платёжный агрегатор ООО «Продамус». Расчёты — в рублях РФ, 100% предоплата. Фискализация — по ФЗ № 422-ФЗ (электронный чек «Мой налог»). The essence of this offer in one paragraph. This document is a public offer (a mixed contract): it combines a licence agreement (Option A — access to the Application's extended features, including ad removal) and an agreement to alienate/transfer source-code rights (Option B — sale of the code). Acceptance is the payment for the selected product via the payment aggregator Prodamus LLC. Settlements are in Russian rubles, 100% prepayment. Fiscalisation follows Federal Law No. 422-FZ (electronic "Moy Nalog" receipt).

Самозанятый гражданин Бойко Дмитрий Николаевич (ИНН: 190158352451), зарегистрированный в соответствии с Законодательством РФ как плательщик Налога на профессиональный доход, именуемый в дальнейшем «Правообладатель» (он же — Исполнитель), выражает намерение заключить настоящий Договор на условиях настоящей Публичной оферты (далее — «Договор») с любым физическим или юридическим лицом, именуемым в дальнейшем «Пользователь» (для конечных пользователей приложений) или «Покупатель» (для приобретателей исходного кода). Self-employed citizen Dmitry N. Boyko (INN: 190158352451), registered under the laws of the Russian Federation as a payer of the Professional Income Tax, hereinafter the "Rights holder" (also the "Contractor"), expresses the intention to conclude this Agreement on the terms of this Public Offer (the "Agreement") with any natural or legal person, hereinafter the "User" (for end users of applications) or the "Buyer" (for acquirers of source code).

В зависимости от выбора цифрового продукта в интерфейсе Сайта или Приложения и совершённой оплаты, Правообладатель обязуется: Depending on the digital product selected in the Site or Application interface and the payment made, the Rights holder undertakes to:

3.1. Полным и безоговорочным принятием (акцептом) условий настоящей Оферты признаётся факт оплаты выбранного тарифа/продукта через интерфейс Платёжного агрегатора (Prodamus). 3.1. Full and unconditional acceptance of the terms of this Offer is deemed to be the fact of payment for the selected tariff/product through the interface of the Payment aggregator (Prodamus).

3.2. Все расчёты производятся в рублях РФ на условиях 100% предоплаты. 3.2. All settlements are made in Russian rubles on a 100% prepayment basis.

3.3. Фискализация доходов осуществляется в соответствии с ФЗ № 422-ФЗ. Электронный чек от системы «Мой налог» формируется автоматически и направляется на Email, указанный Покупателем/Пользователем при оплате. 3.3. An electronic receipt from the "Moy Nalog" system is generated automatically and sent to the email address provided by the Buyer/User at payment.

4. Условия для встроенных покупок и подписок (для Пользователей) 4. In-app purchases and subscriptions (for Users)

4.1. Доступ к функциям «Отключение рекламы», «Снятие ограничений» или «Внутриигровые/внутрипрограммные подписки» предоставляется мгновенно после подтверждения транзакции банком. 4.1. Access to the features "Ad removal", "Lifting of restrictions", or "in-game/in-app subscriptions" is granted immediately after the transaction is confirmed by the bank.

4.2. Момент исполнения: обязательство Правообладателя считается исполненным в полном объёме в момент технического открытия доступа к функциям в интерфейсе ПО. 4.2. Time of performance: the Rights holder's obligation is deemed fully performed at the moment access to the features is technically opened in the software interface.

4.3. Возврат средств за активированные периоды или разовые разблокировки не производится на основании ст. 32 Закона РФ «О защите прав потребителей», так как услуга полностью потреблена в момент предоставления доступа к цифровому контенту. 4.3. No refund is made for activated periods or one-time unlocks under Article 32 of the Russian Law "On Protection of Consumer Rights", since the service is fully consumed at the moment access to the digital content is granted.

5. Условия продажи и передачи Исходного кода (для Покупателей) 5. Sale and transfer of Source Code (for Buyers)

5.1. При оплате Исходного кода Правообладатель обязуется в течение 48 часов с момента оплаты предоставить Покупателю доступ к скачиванию архива с кодом или предоставить доступ к закрытому репозиторию (например, на GitHub). 5.1. Upon payment for the Source code, the Rights holder undertakes, within 48 hours of payment, to provide the Buyer with access to download the code archive or to provide access to a private repository (e.g. on GitHub).

5.2. Объём передаваемых прав: если иное не указано на странице заказа, Покупатель получает право использовать Исходный код для создания собственных конечных приложений, их компиляции, изменения и монетизации. Покупателю запрещается перепродавать, дарить или распространять сам исходный код (текст программы) третьим лицам. 5.2. Scope of rights transferred: unless otherwise stated on the order page, the Buyer obtains the right to use the source code to create their own end applications, compile, modify, and monetise them. The Buyer is prohibited from reselling, gifting, or distributing the source code itself (the program text) to third parties.

5.3. Момент исполнения: обязательства по передаче кода считаются выполненными в момент отправки ссылки на скачивание/репозиторий на Email Покупателя. С этого момента возврат денежных средств невозможен, так как цифровой товар не имеет материальной формы и не может быть возвращён продавцу (ст. 26.1 Закона «О защите прав потребителей»). 5.3. Time of performance: the obligations to transfer the code are deemed fulfilled at the moment the download/repository link is sent to the Buyer's email. From that moment, a refund is impossible, since the digital goods have no material form and cannot be returned to the seller (Article 26.1 of the Law "On Protection of Consumer Rights").

6. Ограничение ответственности 6. Limitation of liability

6.1. Исходный код предоставляется по принципу «как есть» (as is). Правообладатель не гарантирует, что код будет компилироваться без ошибок на оборудовании Покупателя, если у Покупателя отсутствуют необходимые сторонние библиотеки, SDK или установленные IDE (Cursor, Android Studio и т.д.). 6.1. The source code is provided on an "as is" basis. The Rights holder does not guarantee that the code will compile without errors on the Buyer's hardware if the Buyer lacks the necessary third-party libraries, SDKs, or installed IDEs (Cursor, Android Studio, etc.).

6.2. Правообладатель не несёт ответственности за убытки Пользователя, связанные со сбоями в работе рекламных сетей (Yandex и др.) или магазинов приложений (RuStore и др.). 6.2. The Rights holder is not liable for the User's losses arising from failures in the operation of ad networks (Yandex, etc.) or app stores (RuStore, etc.).

7. Реквизиты Правообладателя 7. Rights holder details

Оплата выбранного тарифа или продукта означает, что Пользователь (Покупатель) полностью ознакомился и безоговорочно принимает условия настоящей Публичной оферты. Актуальная редакция всегда доступна по адресу /oferta/index.html. Payment for the selected tariff or product means that the User (Buyer) has fully read and unconditionally accepts the terms of this Public Offer. The current revision is always available at /oferta/index.html.
